Q: What are the "Top 10" violations that are cited in Brickhope Plantation?
A: We inspect your community weekly and
follow an official Inspection Policy to determine what is a violation and help
separate what may be a marginal concern. Your Board specifically asks that
we look for unapproved fences, poorly-placed satellite dishes,
turf care, planting beds, weed control, trimming/edging (citing those
significantly worse than average), house and driveway cleaning, off-driveway
parking, boats, trailers, commercial vehicles, RVs, storage sheds (none are
allowed), play items properly stored, yard art, window AC units
and trash can storage.
Q: What is the process when violations are noted?
A: The Enforcement policy (from the Board
and your community Covenants, above) require that a notice be mailed and
provides for application of fines and other penalties for continued or repeat
non-compliance. They are sent US mail to the address provided to the
Association manager by your closing attorney. As
your managers, we hate sending these just as much as owners hate to receive
them. The goal and purpose is for protection, preservation and enhancement of
property values - not to hassle or harass. We're good people and have no
wish to spread negativity. It is a tough job to maintain the delicate
balance between over and under-enforcement.
Q: What are the fines and how are they applied?
A: All owners should be given a set of
Covenants by their Ryland sales agent and sign a document that attests that each
had read, understood and agreed to abide by what was contained therein.
First communications on a specific violation or concern are always an
informational notice. It notes that subsequent notices may include fines
or other possible corrective actions. Further notices include fines
beginning at $25 and doubling with each recurrent violation or continuing
violation on an interval of no less than 10 days. If you need to make a
reasonable request for additional time to correct a situation, please contact
your manager who has limited authority to grant extensions. The HOA is
not interested in collecting fines, and CMG receives no benefit from the fines.
There is a limited amount of time that you may write in to the address on the
letter for a conditional waiver of a first-time fine. It is very important
to resolve these minor issues for the benefit of your neighbors and your own
property values of course...and to avoid the posting of fines becoming a
collections issue.
Q: How does the collections process work at Brickhope?
A: Your Covenants and Board policy provides
that late fees are charged after a statement is sent and after 30 days. After
the 90-day mark the Association may require
your manager to file a lien (to formalize the Assessment lien already part
of every deed) and after that, the Board may choose to proceed to other
collections avenues as permissible by law.
